In April 1998, AU filed an amicus brief in the California Court of Appeals in support of a challenge to a statutory exemption from anti-discrimination laws for religiously-affiliated institutions that engage in non-religious discrimination. The brief argued that the exemption should extend no further than that allowed under the federal Title VII, which exempts religiously affiliated institutions only with respect to religious discrimination. The Court of Appeals dismissed the case after the California Supreme Court issued its decision in Kelly v. Methodist Hospital of Southern California holding that the exemption was constitutional as written.
